They say the wheels of justice turn slowly, and that is proving to be the case with the Diamond bankruptcy. We had hoped for a final verdict at the end of August but the judge said he wasn’t comfortable issuing one yet, so he pushed it back until October 3. Then, last week, pushed it back another two weeks. He was not impressed with Diamond’s tactics and told them they had better propose a serious plan in this extra time. He is sympathetic to our situation but for whatever reason won’t just rule in our favor now.

Our lawyer thought it was unlikely they would open what are known as adversary proceedings against us, because it would mean individually serving 135 companies. Well, they started doing that this week, working through the companies alphabetically.

Meanwhile, our legal team has been trying to get Diamond to reject our contracts. We need this to happen so our exclusivity with them in the book trade would be legally terminated. We have the Fifth Season RPG and a new edition of The Expanse (both literary properties) coming up so being without book trade distribution right now is especially bad. By dragging the case out like this, Diamond is thus forcing us all to spend more money, money we don’t have, while our product sits in their warehouse.
